Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Participants of the Promotion agree to be bound by these Terms and Conditions.

Promoter: KP Snacks Limited (Company Registration No. 08314505, Registered Office: Fifth Floor, The Urban Building, 3-9 Albert Street, Slough, SL1 2BE).

Data Controllers: 

Jellybean Creative Solutions Limited (Company Registration No. 02303631, Registered Office: 15-17 The Crescent, Leatherhead, Surrey, England, KT22 8DY). 

Source Design Limited (Company Registration No. 06437875, Registered Office: 2 Nettles Lane, Shrewsbury, SY3 8RJ). 

Quantum Marketing Services (Company Registration No. 02500520, Registered Office: Fry’s Yard, Bridge Street, Godalming, Surrey, GU7 1HL).

There are 3 separate Promotions:

  1. Tyrrells’ League of Tyrrellbly Good Taste Display Goodies (referred to as POS Kit below)
  2. Tyrrells’ League of Tyrrellbly Good Taste Prize Draw
  3. Tyrrells’ League of Tyrrellbly Good Taste UGC Amazon voucher

(each a ‘Promotion’ and together ‘the Promotions’)

  1. Tyrrells’ League of Tyrrellbly Good Taste POS Kit (by entering this promotion you are automatically entered into Promotion B – Tyrrells’ League of Tyrrellbly Good Taste Prize Draw).

The Promoter is offering 400 free POS kits under the terms and conditions set out below. 

  1. For the first x50 Participants (as set out at paragraph A9 to A14) a free POS kit made up of: 5 x Tyrrells branded t-shirts (x2 M, x2L and x1L); 1 x A4 strut card; 1 x A5 window decal; 1 x metal clip strip with Tyrrells branding; and x1 wooden display tray with Tyrrells branding; 

Then:

  1. For the next x350 Participants a free POS kit made up of: 1 x A4 strut card; 1 x A5 window decal; 1 x metal clip strip with Tyrrells branding; and x1 wooden display tray with Tyrrells branding. 

Valid Participants will be sent the relevant POS kit to the address provided in the entry form, subject to verification by the Promoter in accordance with these Terms and Conditions.

  1. This Promotion is available from 1 July 2024 until 23:59 on 30 September 2024 or until the 400 samples are all claimed, whichever is earlier, at which point the entry form will be removed from the website.
  2. The 5 x Tyrrells branded t-shirts are only available to the first x50 entrants who fill out and submit the online form. The t-shirts will be supplied in packs of 5 with a sizing split of 2 x M, 2 x L, and 1 x XL.
  3. The Promoter will endeavour to have the POS kit delivered within 4 weeks of receipt of entry by the Promoter.

Eligibility

  1. This Promotion is only open to bona fide pubs, cafés, and foodservice operations that sell crisps in Great Britain (mainland only) (hence forth referred to as “Operators”). 
  2. The Operator must not be associated with:
  1. employees, agents, or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the promotion or its administration; or 
  2. Members of the immediate families or households of a) above
  1. Main contact at the Operator must be aged 18 or over.
  2. The Promoter may require you to provide proof including verification of ID and other eligibility requirements.

How to enter

  1. Entry shall be made through an online form available at:　www.tyrrellscrisps.co.uk/league (the “Website”).
  2. Participants must give a valid email address and business postal address when entering on the online form and complete all mandatory fields.
  3. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, forged, falsified, altered, or tampered with in any way.
  4. By submitting an entry form, you are:
    1. agreeing to be bound by these terms and conditions; and
    2. confirming that you have advance permission from your employer to request the POS kit.
  1. Offer is limited to the first 400 POS entries received by the Promoter. 
  2. Offer is limited to one POS kit per Operator (one entry per operator / business at the same address). No multiple entries will be accepted. Any attempt to try and circumvent this rule by using alternative details will be disqualified from this promotion. 
  1. Tyrrells’ League of Tyrrellbly Good Taste Prize Draw 

Eligibility 

The Tyrrells’ League of Tyrrellbly Good Taste Prize Draw is only open to GB (mainland only) Operators aged 18 or over that requested a FREE POS kit and were verified by the Promoter using the terms set out above. 

How to enter

  1. Operators will be automatically entered into this prize draw when they request a free POS kit via the form (details required include full name, business address, email address, type of business, and preferred wholesaler) on the Website and are verified by the Promoter during the promotional period. If Operators want to opt out of the prize draw, please email liv@jellybeancreative.co.uk to do so before the promotion end date. 
  2. No purchase by the Operator is necessary. Internet access required. 
  3. This Promotion will run from 00:00 1 July 2024 until 23:59 on 30 September 2024 or when 400 kits are claimed, whichever is first. 
  4. Maximum of 1 entry per Operator. 
  5. Entries (bulk or otherwise) made from syndicates, consumer groups or third parties will not be accepted. 
  6. Incomplete, illegible, invalid or misdirected requests will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for requests delayed, incomplete or lost due to technical reasons or otherwise.

Winner Selection & Notification

  1. One winner will be selected from the 400 POS Kit recipients by an independent third party via random selection on the 1st of October.
  2. The winner will be notified via the email they provided on their entry form between the 2nd and 6th of October 2024 and will be asked to claim their prize within fourteen days from the date of this email by replying to email notification. A minimum of two attempts to contact the winner via email will be made during this period.
  3. In the case that they do not respond within 14 days of initial notification, reject their prize or are ineligible, the Promoter reserves the right to award the prize to an alternative winner using the same methodology as above. The process will repeat for 3 months, after which the prize will be null and void. 
  4. The Promoter cannot be held responsible for the winner failing to respond to this notification or failing to supply accurate information which may affect acceptance or delivery. Entrants are encouraged to monitor their email account during this time in case they are the winner, including junk folders.

The Prize

  1. The prize comprises of 70 cases (3,360 x 40g packs) of Tyrrells Crisps stock (flavours selected by Promoter at its discretion) worth £5,000, valued at the sell-out price to consumer of £1.50 per pack (the ‘Prize’). 
  2.  There is only one Prize available to be won. 
  3. Once the winner has provided valid acceptance of their Prize and upon completion of any further verification process, the winning operator will receive the Prize via direct delivery from Tyrrells. The delivery of the prize will be split, with x2 deliveries of x17 cases and x2 deliveries of x18 cases over the course of one year on a quarterly basis. If the winning operator is unable to accommodate x15 cases at once, we will engage in discussions with them to determine the most suitable method for delivering the prize. The Operator will be responsible for any tax liability arising from this Prize.
  1. Tyrrells’ League of Tyrrellbly Good Taste UGC Amazon Voucher Competition

Eligibility 

The Tyrrells’ League of Tyrrellbly Good Taste UGC Amazon Voucher is only open to the 400 POS kit recipients who were verified by the Promoter using the terms set out above. 

How to enter

  1. Operators and their employees can enter this Promotion once the relevant Operator has received its free POS kit, by posting on their business’s public Instagram, Facebook account, or X account using the hashtag #LeagueOfTyrrellblyGoodTaste along with a picture or video of their Tyrrells POS kit on display and mentioning @Tyrrellsofficial for Instagram, @Tyrrells for Facebook and @Tyrrells for X. The post must be in the form of an Instagram grid post, Facebook wall post or a post on your X page. Only posts that adhere to these criteria will be considered valid.
  2. No purchase necessary.
  3. Entrants may make multiple posts, but all posts will be assessed individually when it comes to the winner selection process. 
  4. Entrants must get permission from their employer before entering this competition. The Promoter reserves the right to verify this with the employer and disqualify the entrant if permission is not granted.
  5. Entries are subject to verification and will be declared invalid if they are falsified in any way.
  6. Any posts that are considered detrimental to the brand will be discounted from the competition. 
  7. The Promoter cannot accept any responsibility for entries not received for whatever reason.
  8. This Promotion will run from the day an Operator receives their POS kit until 30th September 2024.

Winner Selection & Notification

  1. The winner will be the owner of the social media account (each social media account will be counted separately even if operated by the same Operator or employee) with the most engagements on their post via comments and likes will be awarded the x1 £50 Amazon voucher. 
  2. In the event of a tie, the winner will be randomly selected by an independent third party.
  3. The winner will be notified via the social media post between the 2nd and 6th of October and will be asked to claim their prize within seven working days from the date of this notification. 
  4. The Promoter reserves the right to award the prize to an alternative winner if the chosen winner cannot be contacted within seven working days of notification through reasonable means (email and phone).
  5. The Promoter cannot be held responsible for winners failing to respond to this notification or failing to supply accurate information which may affect acceptance or delivery. 

The Prize

  1. There is only one prize available: £50 Amazon voucher. No cash alternative.
  2. The winner’s details will be available from liv@jellybeancreative.co.uk from 13th October 2024.

General – applicable to all Promotions

  1. All participants must be over 18. 
  2. The Promoter reserves the right to withdraw these Promotions or to alter or substitute the prize with an alternative of equal or greater value or alter the POS Kits and any other conditions in the case of exceptional circumstances but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  3. No cash or alternatives are available in whole or in part to the prize or POS Kits and, unless otherwise agreed in writing by the Promoter, the prize and POS Kits will only be awarded directly to the relevant participants and winner. 
  4. If fulfilment or any element of this promotion is delayed or affected due to supply chain issues, any affected entrants will be contacted by the Promoter or its agent and kept updated of any unavoidable changes to the promotion or prizes.  
  5. The Promoter, its agents or distributors will not assume responsibility for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or any web site, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating and entering in the Promotion.
  6. The Promoter cannot accept any responsibility for entry forms not received for whatever reason. 
  7. The winning operator may be asked to participate in related publicity with no further recompense.
  8. The Promoter reserves the right to verify all entries including but not limited to asking for proof of ID (passport, driving licence or equivalent). The Promoter reserves the right to refuse to award the prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means.
  9. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, or reasonable belief to suspect collusion to subvert the terms of this promotion, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
  10. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  11. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
  12. These Terms and Conditions shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.  The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the operator surname or business name and county of the prize draw winner to anyone who writes to liv@jellybeancreative.co.uk  set out above (enclosing a self-addressed envelope) within three months after 30th of September 2024. The Promoter reserves the right to refuse such requests. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting liv@jellybeancreative.co.uk. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
  13. Any personal data relating to entrants will be used solely for the purposes of this Promotion and/or by the Data Controllers appointed to assist with running the Promotion on behalf of the Promoter and will not be disclosed to any other third party for any other purpose.  Entrants’ personal data will be kept confidential and will be handled in accordance with current Data Protection legislation and the privacy policy available at https://www.tyrrellscrisps.co.uk/privacy/. Data will be stored for three months after the close of the promotion before deletion. 
  14. By entering the Promotions, all entrants will be deemed to have accepted and be bound by these terms and conditions and consent to the transfer of their personal data in accordance with paragraph 13 above to the Data Controllers (Jellybean Creative Solutions Ltd: Privacy Policy, Source Design Ltd: Privacy Policy, and Quantum Marketing Services: Privacy Policy) for the purposes of the administration of these Promotions and any other purposes to which the entrant has consented in these terms and conditions. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to liv@jellybeancreative.co.uk. By participating in the promotion, you agree to the use of your personal data as described here.
  15. The Promoter’s decisions regarding all promotional matters shall be final and no other correspondence will be entered in to.
